Settlement Information
A Settlement has been reached in a class action lawsuit against Defendant Casey’s General Stores, Inc. (“Defendant” or “Casey’s”). The class action lawsuit asserts claims under the Employee Retirement Income Security Act of 1974 (“ERISA”) concerning a wellness program that allegedly discriminated against employees based on an impermissible health factor by failing to provide a reasonable alternative standard with respect to the Plan’s tobacco surcharge policy.
Who Is a Class Member?
You are included as a Class Member if you are or were a participant in the Plan and paid a tobacco surcharge from January 1, 2019 through December 31, 2025 (the “Class Period”).

You may write to the Court and counsel if you don’t like the Settlement to explain why you object or wish to make comments about the settlement. More information is provided below under section 15. If the Court approves the Settlement, you will get a share of the Settlement benefits to which you are entitled, regardless of whether you objected to or commented about the Settlement. |
Attend a Hearingon October 26, 2026 |
You may ask to speak in Court about the fairness of the Settlement at the Final Fairness Hearing. More information on when and where to attend is provided HERE. If the Court approves the Settlement, you will get a share of the Settlement benefits to which you are entitled, regardless of whether you spoke in Court about the fairness of the Settlement. |
